Terms of Service

1. Agreement and eligibility

These Terms of Service ("Terms") are an agreement between you and Kainotomic Inc. ("Kainotomic," "we," "us," or "our") governing your access to Kainostore, Kainotomic's customer marketplace, developer and administrative services, Kainostore Credits, and related account, purchase, app-launch, hosting, integration, and payout services (collectively, the "Service").

By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old. If you are under the age of legal majority where you live, your parent or guardian must agree to these Terms on your behalf. Individual apps may impose a higher age rating.

2. Accounts

Provide accurate information, keep your credentials secure, and promptly update information that changes. You are responsible for activity performed through your account unless caused by Kainotomic's breach of these Terms or legal duties. Notify us promptly if you believe your account has been compromised.

You may sign in through supported identity providers, including Google. Your use of an identity provider is also subject to that provider's terms. You may not sell, transfer, rent, or share an account in a way that defeats security, eligibility, or enforcement controls.

3. Beta service

Some or all of the Service may be offered as a beta, preview, pilot, or early-access release. Beta features can be incomplete, contain errors, change without notice, or be suspended. Data, balances, app availability, pricing, and functionality in a closed beta may be test data and may be reset or corrected before broader release.

Do not rely on a beta feature for emergencies, safety-critical use, or any purpose where interruption or data loss could cause material harm.

4. Kainostore Credits

Kainostore Credits ("KC") are closed-loop units used to obtain eligible apps, subscriptions, content, features, usage, or in-app products on Kainostore. Our current reference rate is 10 KC for US$1.00, but the amount of KC included in a funding offer or promotion will be shown before you confirm it.

• KC are not legal tender, cryptocurrency, stored-value bank funds, or an investment and do not earn interest.
• KC are personal, non-transferable, and may be used only for eligible transactions on the Service.
• KC have no cash value and are not redeemable for cash except where applicable law expressly requires otherwise.
• Promotional, test, goodwill, or administrator-granted KC may have additional limits and may be corrected or revoked if issued in error, obtained through abuse, or tied to an invalid transaction.

Kainotomic maintains the authoritative ledger for KC funding and spending. Displayed balances may be adjusted to correct duplicate, reversed, fraudulent, refunded, or technically invalid entries.

5. Apps and purchases

Apps may be free, paid once, subscription-based, usage-based, or free with paid in-app products. A listing will identify the applicable price and available product information. Confirm the displayed item and price before purchasing.

Unless a listing states otherwise, an app purchase provides a limited, personal, revocable, non-exclusive, non-transferable right to access the applicable app through your Kainostore account. It does not transfer ownership of the app or its intellectual property.

In-app products may be consumable, durable, time-limited, metered, or managed by the app. Kainotomic records the purchase and issues a server-verifiable fulfillment claim. For app-managed products, the app developer is responsible for delivering the item or feature after receiving a valid claim. Contact support if fulfillment fails.

Developers and hosted apps

Apps may be built by Kainotomic or by third-party developers and may be hosted by Kainotomic, hosted with Kainotomic's assistance, or hosted by the developer. Kainotomic reviews apps and product requests under its current marketplace process, but review is not a guarantee that an app will always be available, error-free, appropriate for every user, or free of all risk.

An app may maintain its own database and terms for app-specific profiles, documents, gameplay, content, or usage. Those terms may not override your rights under applicable law or these Terms for Kainotomic-controlled services.

6. Subscriptions

A subscription gives access to an app's product for the period shown when you subscribe, paid in KC, while the app remains approved on Kainostore.

Auto-renew is your choice. A subscription renews only if you turn on auto-renew for it in Wallet → Subscriptions on Kainostore. It is off for every subscription until you turn it on, and subscribing inside an app never turns it on. Before you confirm, we show you the date and price of the next renewal. Daily subscriptions cannot renew automatically.

How renewals are charged. When auto-renew is on, each renewal is charged from your KC balance as the period ends, at the product's current price, and the new period starts when the old one ends. We email you two days before each renewal with the price, and tell you then if your balance will not cover it.

Price changes. A developer may change a product's price or period. We email you before a new price applies to you. You are charged only a price we have told you: a change made less than three days before a renewal applies from the next renewal, and if we cannot confirm that our email about a change went out, the renewal is charged at the last price we told you. A lower price can apply without notice.

If your balance is short. If your balance does not cover a renewal, you keep access for 24 hours so you can top up. We try again when your balance covers it and when the 24 hours end. If it is still unpaid, the subscription ends and nothing is charged.

Turning it off. You can turn auto-renew off at any time before a renewal. You keep access until the end of the period you paid for, or of the 24 hours above, and can turn it back on until then, unless the subscription was canceled or refunded.

Refunds. Turning auto-renew off does not refund the current period, and renewals are not refunded automatically. You can ask for a refund, which we review as described in section 7. If a subscription purchase or renewal is refunded, the subscription is canceled, stops renewing, and access for the refunded period ends.

Apps that leave Kainostore. If an app is delisted, suspended or stops being approved, or its product is retired or changed so it can no longer renew, auto-renew stops and we email you. If an app is suspended or stops being approved, access to it and its subscriptions stops, even during a paid period. Nothing is refunded automatically; see section 7. A payment reversal or account restriction may also end a subscription and suspend the related entitlement.

7. Payments, taxes, and refunds

Payment processing is provided by Stripe and may be subject to Stripe's terms and privacy practices. You authorize the applicable charge when you confirm a wallet funding or other real-money transaction. You are responsible for applicable taxes and for keeping your payment information current.

Except where required by law or expressly stated in an offer, completed wallet funding and purchases are final. We review refund requests case-by-case, including duplicate charges, technical failure, fraudulent activity, or failed fulfillment. If a payment is refunded, reversed, disputed, or charged back, Kainotomic may remove the related KC, entitlement, subscription, app access, or developer proceeds.

Auto top-up

Auto top-up is optional and off until you turn it on in your Wallet. To turn it on, you choose a balance and one of our top-up packages, and you save a card through Stripe. You authorize us to charge that card for the package you chose, without asking you each time, when:

• your KC balance drops below the balance you chose; or
• two days before a subscription renews with auto-renew on, your balance will not cover the renewal.

Each charge adds the package's KC to your balance like any other top-up, and is final as described above. Stripe stores your card; we keep only its brand and last four digits, to show it to you. If your bank declines a charge or asks you to confirm it, we email you so you can top up yourself.

You can turn auto top-up off, or remove the card, at any time in your Wallet. Either stops future charges; neither refunds a charge already made. Auto top-up also stops if the card is removed at Stripe, and we may pause it to protect your account.

8. Acceptable use

You may not use the Service to:

• Violate law, third-party rights, or applicable app rules.
• Defraud users or developers, manipulate KC or purchase records, or evade pricing, rate limits, eligibility, review, or enforcement.
• Access another person's account, distribute malware, probe systems without authorization, disrupt the Service, or misuse APIs, credentials, tokens, fulfillment claims, or app callbacks.
• Scrape or automate access in a manner that materially burdens the Service or violates published technical restrictions.
• Upload or distribute unlawful, infringing, deceptive, abusive, or harmful content.

9. Content and intellectual property

Kainotomic, its licensors, and app developers retain their respective rights in the Service, apps, brands, software, designs, documentation, and content. Except for the limited access rights expressly granted by a listing or these Terms, no rights are transferred to you.

You retain ownership of content you submit. You grant Kainotomic a limited license to host, process, reproduce, and display that content as reasonably necessary to operate, secure, support, and improve the Service and to carry out actions you request. You must have the rights needed to submit the content.

10. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend, or terminate an account, app, purchase capability, payout, or access where reasonably necessary to address fraud, security risk, legal requirements, payment reversal, harmful conduct, material breach of these Terms, or risk to users or the Service.

Where practical and lawful, we will provide notice and an opportunity to resolve the issue. Certain provisions, including those concerning payments, ownership, disclaimers, liability, enforcement, and retained records, survive termination as necessary to give them effect.

11. Disclaimers and liability

To the maximum extent permitted by law, the Service and beta features are provided "as is" and "as available." Kainotomic disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

To the maximum extent permitted by law, Kainotomic is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Service. Kainotomic's aggregate liability relating to the Service will not exceed the greater of the amount you paid to Kainotomic during the 12 months before the event giving rise to the claim or US$100. These limits do not apply where applicable law does not permit them.

12. Changes and contact

We may update these Terms as the Service, our business, or applicable requirements change. We will post the revised Terms and update the date above. If a material change requires additional notice or consent, we will provide it. Continued use after the effective date of revised Terms means you accept them to the extent permitted by law. Changing these Terms never turns auto-renew on for a subscription.

These Terms do not limit rights you cannot waive under applicable law. Before starting a formal dispute, please contact us and give us a reasonable opportunity to investigate and resolve the issue.
